Workers' Compensation

Workers' compensation is a wage replacement and medical care program for workers who suffer a work-related injury or illness. In Utah, workers' compensation law is governed by the Workers' Compensation Act, and administered by the Labor Commission of Utah. The Workers Compensation Act requires most employers to provide workers' compensation insurance for their employees. This insurance covers medical expenses and lost wages for work-related accidents and illnesses. The insurance does not compensate for pain and suffering.

Employers get to choose their workers' compensation insurance provider. The largest provider in Utah is Workers Compensation Fund, a quasi-government company that must provide insurance to any employer that pays the premiums. Large employers may qualify for self-insurance. Employers must pay employee's workers' compensation insurance premiums. Employers are not allowed to deduct workers' compensation premiums from an employee's pay.

What to Do After a Work-Related Injury or Illness


You have 180 days to report a work-related injury or illness. However, it is good practice to immediately report accidents or illnesses. Your employer is required to fill out Employer's First Report of Injury or Illness within seven days from when they receive your report. You are to receive a copy of the report with a statement of your rights and responsibilities.

Your physician will fill out the Physician's Initial Report of Injury or Illness. You should tell your physician how, when, and where the accident happened.

The workers' compensation insurance carrier has 21 days from the receipt of these reports to accept, deny, or notify you of further investigation. If further investigation is conducted, the carrier may have an additional 24 days.
